Represented confidential gas and technology company against contractor for breaches of an engineering, procurement, and construction agreement. Claimant sought recovery of liquidated and non-liquidated damages resulting from contractor’s failure to complete industrial facility on time or within budget and contractor’s refusal to assign engineering work, subcontracts, and materials for which project owner paid. Claimant is also pursuing recovery of equipment for which it paid. This arbitration is ongoing.

Confidential Pre-Litigation Dispute
Represented oil and gas producer in a land use dispute with a North Texas real estate developer. The developer trespassed on the producer’s well pads, destroyed producer’s access roads, and repeatedly struck underground gas gathering pipelines with construction equipment. Drafted original petition, application for temporary restraining order, and application for temporary injunction to enjoin the developer’s dangerous construction activities. The developer agreed to consult with producer before future work, cease trespassing, and fix all damage when faced with litigation and potential work stoppage.
