ExxonMobil, in the 190th Judicial District Court, Harris County, Texas
Represented ExxonMobil in a lawsuit arising out of ExxonMobil’s actions as unit operator of the Conroe Field Unit. ExxonMobil delivered gas on behalf of itself and 280 other working interest owners to a gas processing plant owned by Duke. Duke sued alleging 11 causes of action against ExxonMobil and contending that certain accounting errors and re-allocations by ExxonMobil had caused Duke to overpay $4.4 million to other working interest owners and seeking to recover damages in the amount of all un-recouped overpayments plus more than $2 million in attorneys’ fees. The case proceeded to trial, and the jury returned a full defense verdict, rejecting all of Duke’s claims.
