Hogan Thompson Schuelke Secures Class Action Dismissal in Colorado Federal Court for IKAV and SIMCOE
On February 2, 2026, Hogan Thompson Schuelke secured a dismissal in the U.S. District Court for the District of Colorado on behalf of clients SIMCOE LLC and IKAV Energy Inc. in a class-action lawsuit over alleged royalty underpayments. The plaintiffs, a group of mineral rights owners in La Plata and Archuleta Counties, Colorado, claimed they were underpaid for gas production. However, Chief Judge Philip A. Brimmer agreed with our position that the court lacked authority to hear the case, resulting in the dismissal of all of plaintiffs’ claims.
