Hogan Thompson Schuelke Wins Sixth Circuit Appeal for Long Point Energy Title Dispute in the Utica Shale

Energy litigation firm Hogan Thompson Schuelke secured a significant title victory for Long Point Energy involving valuable lease interests in the Utica Shale in Ohio. The firm was originally retained by Long Point after an Ohio district court had dismissed the client’s lawsuit against two major oil and gas companies.

The firm successfully appealed the dismissal to the U.S. Court of Appeals for the Sixth Circuit. In a unanimous ruling, the appellate court reversed the district court’s grant of summary judgment and remanded the case for further proceedings.

Following the successful appeal, the firm engaged in extensive briefing on complex ownership issues, including application of the Ohio Dormant Minerals Act. On remand, the same district court that had previously dismissed the case prior to Hogan Thompson Schuelke’s involvement granted summary judgment in favor of Long Point Energy, officially awarding the client title to the disputed Utica Shale property.

The case remains ongoing as the firm moves into the damages phase of litigation.
