El Dorado Gas & Oil, in the 343rd Judicial District Court, McMullen County, Texas

Represented an oil and gas producer in a jury trial in McMullen County, Texas. Brought claims against affiliates of Energy Transfer based on damages caused by the companies’ underground storage of acid gas. After a two-week trial, secured more than $17,000,000 for El Dorado based on trespass claim.

Long Point Energy, Southern District of Ohio Federal Court and Sixth Circuit Court of Appeals

Represented Long Point Energy in a lawsuit it brought against two major oil and gas companies related to ownership of a valuable lease in the Utica Shale and production from that lease. Hired following an order from the district court dismissing Long Point Energy’s claims. Represented Long Point Energy on appeal to the Sixth Circuit Court of Appeals, which reversed the district court’s summary judgment grant and remanded the case. On remand, filed a motion for summary judgment and secured a summary judgment order affirming Long Point Energy’s title to the lease. Case remains ongoing related to Long Point Energy’s claims for damages.

Arch DW Reagan 2021 LP & AIP DW Reagan, LP v Kimmeridge Texas Gas, LLC, in the 14th Judicial District Court, Dallas County, Texas

Represented operator in joint operating agreement lawsuit with non-operator. Non-operator alleged that operator breached the operating agreement after wells were damaged by offset completions. Filed counterclaim for unpaid joint interest billings related to workovers. The case settled on confidential terms.

Stateline Operating LLC v. Aris Water Solutions, Inc. et al., 143rd Judicial District Court, Loving County, Texas

Representing Aris Water and affiliates in a lawsuit in Loving County, Texas brought by a New Mexico oil and gas operator, Stateline Operating. Stateline alleges that water Aris injected into its shallow DMG saltwater disposal wells in Texas migrated subsurface to Stateline’s wells in New Mexico and allegedly "watered out" Stateline's wells and mineral interests in the Avalon, First Bone Spring, and Second Bone Spring Formations. Stateline seeks hundreds of millions of dollars in economic damages and more than $2 billion in punitive damages. This case is ongoing.
